Terms and Conditions
My art is 100% human made, No AI.
• By commissioning me, you agree to the terms below.
• I reserve the right to refuse a commission for any reason.
• The commission will only be started after I accept and the payment is done.
•Communication will be conducted via email, discord or a preferred social network.
•I work on a first-paid-first-serve basis. When I confirm your slot I will inform you when I'll be able to start on your project, along with confirmation of your commission details and payments discussion.
Payment
• Payments must be made through Vgen Payments.
• Full Payment Upfront or 50% Payment must be done upfront before starting the commission and 50% after it's finished.
• Refunds are only possible if I cancel the commission in case I can't finish for any reason.
• You can cancel anytime if your not happy with my services provided, not needing to other half of the payment. (In case you haven't paid full)
Process and delivery
• It can take 5 days to 15 business days to complete the commission depending on the complexity and type of commission.( I don't work on weekends)
• If you have a deadline, please check if it's within the estimated delivery time; I cannot expedite the process.
• Commissioner will have to maintain a clear regular communication and quick responses for the revisions, in case failure to respond for more than 24h, the deadline will be changed.• Revisions will be sent to review after rough sketch, lineart and color and render for full rendered commissions, as for color base you also get 3 revisions.
• Only possible 1 minor change without charge after art is finished. A fee will be added if you want something major changed on the final drawing ( such as; pose, objects,lighting).
• You will get the file (.jpg, .png and .tiff) of the artwork in the best quality throught your email with a link to dowload.
• In case you need the PSD files we shall discuss about it.
Copyright and Usage
• You (the commissioner) must specify whether the work is for personal or commercial purposes.
• I (the artist) retain full copyright and ownership of all commissioned work.
• You retain the rights to the intellectual property (IP).
• You may NOT alter the commissioned artwork without my (the artist's) consent.
•You may credit all my art when posting on social media.
• I reserve the right to post the commissioned artwork online, in my portfolio as well.
• Personal use commissions are allowed to use the art for personal reasons only such as, printing for youself and friends, gifts, personal social media, etc., as long is credit to me and no plagiarizing, copying, disturbing, editing of any kind.
You are not allowed to sell, use it as merch, promotion, marketing or any other commercial activity.
• Commercial License (exclusive) allows you to use artwork for any commercially purpose and profits, being able to display in all media, in perpetuity. I may still use for portfolio.
• You are not allowed to use any of my art for any AI and NFT, even if they paid for commercial rights.
In the event of a breach of these Terms of Service by the commissioner, the commissioner will be blacklisted and will be permanently prohibited from commissioning the artist (me) again. The matter may be resolved through legal means as well
